1. Acceptance of these Terms

By creating a GuardianX account or purchasing a subscription, you ("Customer") agree to these Terms of Service. If you do not agree, do not use GuardianX.

2. Description of the Service

GuardianX is a device-oversight platform that allows an administrator to manage, verify and audit devices the Customer owns or is legally authorized to administer. GuardianX is provided for parental device management and employee-device management use cases only.

4. Subscription, billing and Merchant of Record

GuardianX subscriptions are sold in 6-month and 1-year terms as published on our Pricing page. Payments, invoicing and applicable taxes are handled by Creem.io, acting as Merchant of Record for this transaction. Your purchase is subject to Creem's applicable payment terms in addition to these Terms.

5. Cancellation

Subscriptions are pre-paid for the selected term and do not auto-charge for a new term without your action. You may cancel renewal at any time from your account or by contacting support; cancellation stops future billing but does not itself entitle you to a refund of the current term (see Section 6).

Refund eligibility is described in our Refund Policy, which forms part of these Terms.

7. Acceptable use

GuardianX is built to support legitimate and secure management. To ensure privacy and compliance, the platform should only be deployed on devices you are legally authorized to manage, and should not be used for undisclosed tracking or credential gathering. Full prohibited uses are listed in our Responsible Use Policy. Violation may result in immediate suspension or termination without refund, without prejudice to any other remedy available to us.

8. Customer responsibilities

Customer is solely responsible for: providing legally sufficient notice to device holders; obtaining any consent required by applicable law; and using data obtained through GuardianX only for lawful, authorized purposes.

9. Intellectual property

GuardianX and all associated software, branding and documentation remain the property of the GuardianX operator. Customer receives a limited, non-exclusive, non-transferable right to use the service during an active subscription.

10. Disclaimer of warranties

GuardianX is provided "as is". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of these Terms will not exceed the amount paid by Customer for the subscription in the 12 months preceding the claim.

12. Termination

We may suspend or terminate access immediately if we reasonably believe the Service is being used in violation of Section 7 or applicable law.
